Right now, Michigan and Colorado are considering legalizing all forms of online gambling. Illinois, North Carolina, and Tennessee are contemplating legalizing sports betting. Meanwhile, Montana is of the mind to legalize online casinos and sports betting, but not poker.

In some states, such as Michigan and Colorado, laws have already been passed to legalize betting games and internet sports wagers. However, gambling sites have not yet launched. A Brief Look at the Early Gambling Laws in the United States

The United States has had a love-hate affair with gambling in the past.  Lotteries were instrumental in the early days of the country as a way of generating rapid revenue. By the mid-1800s, public opinion had shifted. Underworld figures were pocketing a sizeable chunk of change, but for the authorities in charge, it was a different story. Gambling was frowned upon if not outright banned.

Following the stock market crash of 1929, many authorities once more turned their eyes to gambling, and Nevada began to transform the desert into what would one day become the Las Vegas Strip. Within two decades, the story would see-saw in favor of banning gambling again. What was once a dust bowl offering casino games in the middle of nowhere, suddenly became important to people. Nevada was the place to be if you wanted to bet online.

Nevada wasn’t alone. Atlantic City in New Jersey sprang up to rival Las Vegas in 1977. Lotteries and pari-mutuel betting options followed, and even riverboat casinos sprang up in Louisiana and some southern states.

The Federal Wire Act Changes Things

As long as there has been some form of gambling, there have been people exploited it. To get around underworld bosses and other shady characters taking advantage of gambling to line their pockets unfairly, the Federal Wire Act came into force. Introduced in 1961, it prohibited betting businesses, put paid to interstate sports betting, and promised fines or prison sentences for those who broke the law. As a federal law, this applied everywhere.

When the Federal Wire Act was brought into being, it didn’t take into consideration the prospect of internet gambling. How could it have done? It was the 1960s. The Federal Wire Act was designed to counter the forms of betting currently in existence. It didn’t hold much water for online gambling.

The problem with the Federal Wire Act was that it was outdated. Following a Department of Justice review in 2018, the DOJ decided to “reinterpret” the Federal Wire Act. Although some believe their opinion was meant to allow cross-border online sports betting, according to the DOJ the reinterpretation envisions the FWA extending beyond sports betting. However, no new plans are currently in place to enforce the modern interpretation of the Wire Act until late 2024.

The US Introduces the UIEGA

The limitations of the Federal Wire Act were clear for all to see. Something else needed to be done to prevent internet gambling exploding. This came in 2006 and is known as the UIGEA, or Unlawful Internet Gambling Enforcement Act. What the UIGEA 2006 does is make it illegal for banks and other monetary institutions to process transactions that are known to be used for gambling.

Such a move was devastating for online casino operators in the United States. Unsurprisingly, many moved offshore. Most snapped up easy-to-obtain licenses from Curacao and neighboring countries. However, these licenses are considered less legitimate that those out of Malta or the United Kingdom. The primary reason is that Curacao and its surrounding licensing jurisdictions do not regulate the casinos it hands licenses to.

From 2015 onwards, many US states have decided to take gambling laws into their own hands. They are freely allowed to do this, and as we’ve seen above, quite a few are now legalizing or have already legalized gambling games.

Online Gambling in the United States

To date, the US is a patchwork of laws where gambling is legal in one state and not in another. Because of the Federal Wire Act, it is not lawful to gamble across state lines wherever you reside. However, if you are living in one of the states where gambling is legal, you are permitted to bet online.

US players can only legally wager at regulated and licensed casinos from within the state where they reside. However, US players living in states where gambling isn’t legal aren’t (and never have been) short of options.

Since the introduction of the UIGEA act in 2006, these US citizens have turned to “offshore” or “foreign” casinos to play. These sites typically cater to American players and accept the US dollar as their currency of choice. The use of Bitcoins, prepaid cards, and other means of payment has helped US players get around financial restrictions, too.

While, in theory, it is illegal for any US players to wager at offshore casinos, there are no punishments for doing so. With that in mind, it is not surprising to see US players in these states where gambling is restricted, gambling online at offshore casinos.

There are benefits from playing at US online casinos. First and foremost, there is the obvious. You will save yourself a fortune by staying at home and not having to travel the glitzy and glamorous Las Vegas, or its Eastern counterpart, Atlantic City. You won’t have to wait to play games, you can walk away at any time, and you’ll generally have a more extensive selection of titles to choose from.

The reason why it’s so difficult for Americans is the Unlawful Internet Gambling Enforcement Act – UIGEA. The core function of this bill is to prohibit banks from processing payments to and from players.

To make a long story short, the UIGEA made it illegal for financial institutions (see: banks) to handle, store, or move any funds relating to wagers that were made illegally. So, for example, if a state has a complete and total ban on all sorts of online gambling, it would be illegal for banks to even touch gambling money coming from that state. Apart from this, the bill says absolutely nothing about it being illegal to place bets and win real money.

To continue off of this point, the absence of laws prohibiting online casinos from existing is exactly what allows them to exist. Basically, until there is a law passed stating that online casinos are illegal, you, as a player, will never have to worry about facing legal repercussions as a result of a placed blackjack bet or wager on a sporting event. No matter what your friends tell you, or what you read on the internet, the fact of the matter is that if you are granted access to an online casino and are able to make a deposit, you are doing absolutely nothing that is illegal and should have nothing to worry about.

Another option is to play from home – usually referred to as ‘social’ gambling. These are legal in roughly 2/3 of states. It’s only allowed if no one profits from running the game, which includes charging a fee, raking the pot, or charging people for food/beverages.

Definitely do your homework first, though. Some states DO NOT allow home poker games and are aggressive in stopping them – with SWAT. And, no, I am NOT joking.

Nevada (Las Vegas & Reno)

Known to many as the casino capital of the world, Las Vegas is the number one destination city for casinos and everything that goes along with them. For a long time, Las Vegas was the only place you went if you wanted to gamble in the US, as it legalized gambling in 1931. Today, people flock to Las Vegas’ strip from all over the world in order to visit some of the most highly distinguished casinos.

Each and every year, Las Vegas plays host to the most prestigious event in the casino world, and that is the World Series of Poker. This mid-summer event attracts millions of visitors and participants who hope to leave Sin City the poker professional they wished to be when they arrived.

When most people look into visiting casinos in Nevada, they often think of Las Vegas. Though Vegas may be considered a gambling mecca, Reno is extremely popular in its own right. Each year, Reno draws in over 5 million visitors. The city is home to a wide variety of resort-style casinos that offer 24/7 gambling in the form of table games, sportsbooks, and class III games.

Atlantic City, New Jersey

Atlantic City opened up its first legal casinos in the late 1970s after they were finally granted permission to exist by the state. The first casino to open its doors in Atlantic City was named Resorts and is still standing to this day. At the time Atlantic City legalized gambling in casinos, the only other place in the United States with legalized gambling was Las Vegas. For people who lived closer to the North East, Atlantic City was a much more viable vacation destination than Las Vegas. Not only that, but the proximity to the ocean made Atlantic City a more reasonable vacation destination to take the whole family.

Now, more than 30 years after the first casino opened up, Atlantic City remains the most popular casino destination on the Eastern side of the United States.

California

California is arguably the most well-known state in all of the United States, so it makes sense that they offer a wide selection of casinos. Since 2000, casinos in the state have been growing faster than ever. While there has been card rooms and horse tracks for a long time, mega-casinos are starting to pop up throughout the state. The most unique dynamic of California is found in its different types of casinos. Some destinations have hundreds or thousands of machines, while others have zero. Casinos in California exist in much the same way as they do in Florida and other states, with one general exception. Though it is true that the only conventional casinos are owned by Native Americans, and thus exist in obscure locations (for the most part), the other half of the story is that instead of gambling solely at dog and horse tracks, California has a growing number of card rooms.

Pennsylvania

Casinos in Pennsylvania saw their biggest growth between the mid to late 2000s, and almost every area of the state has at least one casino in its region, with the Eastern region being most heavily populated.

Florida

Casinos in Florida exist sparsely when compared to places like Las Vegas and Atlantic City. Unlike New Jersey and Las Vegas, the only casinos that exist are under the control of the Native American tribes. While these casinos are fine to play at, they do not exist in abundance and because of this Floridians and those traveling there are confined to dog racetracks if they hope to gamble at an establishment now owned by Native Americans. With that being said, apart from some poker rooms and slot machines, many of these dog tracks are ill-equipped in terms of table games and slot machines.

Ohio

Ohio is another US territory that sees brick-and-mortar gambling as a very modern addition. As is the case with states like Delaware and Pennsylvania, this state only recently began to offer slots and ultimately table games.

Ohio is unique in that it is not near a heavily concentrated gambling destination, as you would find with PA or DE as they relate to Atlantic City or Las Vegas when it competes with California Ohio has a number of different gaming brands represented within the state.

Oklahoma

Oklahoma first started offering traditional casinos in 2004 and has since become one of the largest gambling destinations in the USA. Today it features over 90 different Native American casinos, including the largest casino in the United States.
